Massachusetts: More than 40 companies notify state gaming commission they want sports betting licenses

(Massachusetts).- More than 40 companies responded to the Massachusetts Gaming Commission’s request that they offer notice that they’re interested in a sports betting license. The commission released a list released Thursday morning that provides insight into which entities are looking to come to the state’s burgeoning sports wagering market.

Commissioners asked any company interested in obtaining a sports wagering license to turn in a notice of intent form by Wednesday “in order for a landscape of interest in sports wagering licenses to come into focus,” the Gaming Commission said. The companies included on the list range from prominent industry players such as DraftKings to local groups like the Massasoit Greyhound Association, which owns Raynham Park.


Twelve companies originally sent in forms ahead of the Aug. 31 deadline, and the updated list now includes FanDuel Group, G3 Esports, Caesars Sportsbook, FanLogic, Mohegan Digital, Penn Sports Interactive, Plainville Gaming and Redevelopment, Sterling Suffolk Racecourse, Fubo Sportsbook, BetMGM, Resorts World Bet and Seminole Hard Rock Digital, among others.


At a webinar earlier this week, Foley Hoag Partner Kevin Conroy, a sports betting specialist, said none of the 12 original companies jumped out as surprising.


“It seemed to be a kind of good combination of the folks who we know are going to be playing in this, and then online operators who have bid in other states,” he said. The Gaming Commission said they requested the form for informational purposes only and to understand the potential field of companies either looking for a wagering license or who want to enter the market as a vendor.


The nine-question form asks for contact information, whether the company is licensed to conduct sports betting in another jurisdiction, a brief description of the business it will likely conduct in Massachusetts, what type of entity they are, and if it has applied for a license in another part of the country.


Many of the companies who have turned in forms are known players in the sports betting world, and regional experts have said they were not surprised by the original 12 who sent in their documents.


Sports betting Attorney Daniel Wallach told MassLive that because Massachusetts offers seven untethered digital sports wagering licenses — companies do not need to be connected to a casino or racetrack — the market here may allow for more start-ups.


“This is one of the few states that provides a point of entry for startup companies,” he said. “Massachusetts will attract your fair share of start-ups and smaller companies that are looking for a foothold in the online gaming component.”Massachusetts’ sports betting law, which Gov. Charlie Baker signed on Aug. 10, allows for three license categories. A complex regulatory road is ahead, and the commission is scheduled to provide an update on that process at their next meeting on Sept. 8. Commission attorneys say they have identified 225 potential topics that will require regulations, from how a bet is placed to the technical aspects of online wagering.


Companies that apply for one of the seven digital wagering licenses are also expected to undergo complex applications, experts say, based on the process casinos went through when they were first being set up in the Bay State. The notice of intent forms are just the first step.

Category one pertains to the three casino and slot parlor operators, allowing them to offer in-person wagering and digital betting through no more than two individually-branded mobile applications. Category two covers the live horse racing tracks and simulcasting facilities — Raynham Park and Suffolk Downs — permitting them to facilitate in-person betting and digital wagering through no more than one individually-branded mobile application or platform. Category three allows for up to seven licenses to be issued to companies that offer sports betting through a mobile application or digital platform. The bid for digital licenses is expected to turn into a competitive process, should more than seven companies officially apply.


The Gaming Commission has been tasked with standing up and regulating the new sports betting industry. Members have indicated that it may take some time before people in Massachusetts can place a bet on their favorite sports team.
